These terms are an agreement between you and Noky (“we”, “us”) about using Lune, a diary where you share one photo each night. By creating an account or using Lune, you agree to them.
1. Who can use Lune
You must be at least 13 years old, and old enough to agree to these terms where you live. If you are under the age of majority, a parent or guardian must agree to them for you.
2. Your account
You sign in with Apple. You are responsible for what happens on your account. Your username must not impersonate anyone or mislead people. You can delete your account at any time in the app (Account → Delete Account); this permanently removes your pages, photos, friends and groups.
3. Your content
You keep ownership of the photos and words you post (“your content”). So that Lune can work, you give us a worldwide, non-exclusive, royalty-free licence to store, process and show your content to you and to the people you choose to send it to, only to run and improve the service. The licence ends when you delete the content or your account, except for copies we must keep by law or to handle a report.
Only post content you have the right to share, and that does not show anyone who has not agreed to it.
4. No objectionable content or abusive behaviour
Lune has zero tolerance for objectionable content and abusive users. You must not post or send content that:
- is sexually explicit, or sexualises minors in any way;
- harasses, bullies, threatens or intimidates anyone;
- promotes violence, self-harm, terrorism or hatred against people for who they are;
- is illegal, infringes someone else’s rights, or shares someone’s private information without their consent;
- is spam, a scam, or malware.
Anyone can report a page from its menu and block a person, which ends the friendship and stops all contact. We review reports within 24 hours, remove content that breaks these terms, and suspend or remove the accounts responsible.
5. Lune Premium
Lune Premium is an auto-renewing subscription (monthly or yearly) bought through Apple. Payment is charged to your Apple Account when you confirm the purchase. It renews automatically unless you turn it off at least 24 hours before the end of the current period; you can manage or cancel it in your Apple Account settings. Refunds are handled by Apple under its policies. Your pages are never deleted because you stop paying; only reading pages older than 30 days needs Premium, and export is always free.
6. The service
We may change, pause or stop parts of Lune. Letters are meant to be fleeting: friends’ pages disappear at the end of their day, and we do not keep them for recipients. Keep your own copies of anything important (Diary → Export).
7. Ending your use
You can stop using Lune and delete your account at any time. We may suspend or end your access if you break these terms or if required by law.
8. Disclaimers and liability
Lune is provided “as is” without warranties of any kind, to the extent the law allows. To the extent the law allows, we are not liable for indirect or consequential losses, and our total liability is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits rights you have under consumer law that cannot be limited.
9. Apple
These terms are between you and us, not Apple. Apple is not responsible for Lune or its content, has no obligation to provide support for it, and is a third-party beneficiary of these terms with the right to enforce them against you. Apple’s Licensed Application End User License Agreement also applies to your use of the app.
10. Changes
We may update these terms. If a change is significant, we will tell you in the app before it takes effect. Using Lune after that means you accept the new terms.
11. Law
These terms are governed by the laws of Taiwan (R.O.C.), except where your local consumer law says otherwise.
